What is GO WISELY?
G = Grounds
O = Object/Objective from search
W = Warrant
I = Identification
S = what station your at
E = Entitled to copy of search
L = legislation/law for search
Y= Youβre detained for the purpose of a search
What power can you use force under?
Section 117 of PACE allows you to use reasonable force.
If you are looking for a suspect carrying a large quantity of drugs, what law would you search them under?
Section 23 misuse of drugs act!
What is the main legislation used for stop and searches?
Section 1 PACE
What is a JOG search?
The most basic of the the 3 searches, that can be performed anywhere by an officer of either gender:
J = Jacket
O = Outer coat
G= Gloves
This search also allows officers to search under collars and in shoes and socks.
What is a MTS search?
MTS = More through search
these must be completed by two officers the same gender as the suspect. This just also be completed out of the public view.
This could include taking off t-shirts, or any clothing the officer deems necessary other than clothing which reveals indecent parts.
What does an EIP search mean?
EIP= Exposure of intimate parts.
These are searches that will take place in a certain cell within custody. It will consist of two officers the same gender as the suspect. This search can remove all items of clothing including looking in and around indecent parts of the body. This was also commonly known as strip searching.
NOTE: this search is not as a result of an MTS search where nothing is found, but rather from a source of intelligence.
What does PLAN mean?
All stop and searches should be;
P= Proportionate
L= Lawful
A= Accountable
N= Necessary
What is S60 Of PACE?
Section 60 grants Police officers the authority to stop and search people in a marked area with specific times. This is usually authorised by an inspector or higher.
An example of this could be a train station on a derby day between Pompey and saints, as there is a possibility weapons could be carried.
What is S60AA of PACE?
Section 60AA of PACE allows police constables to remove disguises such as mask if they deem the person is hiding their Identity in relation to a concealed weapon or prohibited item.
NOTE; This does apply to Religious clothes such as Hijabs, however out of respect for the religion and person, the person should be taken out of the public eye and into a safe location to remove.
Q1) You are in a Rural area looking for a white male wearing a black hoodie carrying a large quantity drugs. You spot two males, One matches the description of the suspect. Do you have the grounds to stop this person, and What legislation would you use?
The answer is yes! you have the grounds to stop this person under section 23 misuse of drugs act as they match the description given by CWUN! The person would be arrested for possession with intent to supply!
Q2) CWUN puts over the radio that a mobile phone was stolen from an elderly man In downtown. You are in the immediate proximity of this location and notice and young male holding a similar device. Your gut instinct tells you that is the suspect. Do you have reasonable grounds to stop him? What Legislations what you use?
The answer is no! Even though he was seen in the area where the crime has been committed, CWUN has given us no description and therefore you cannot have grounds from gut instinct.
Q3) You stop and search two males that match the description of two people
Who robbed an old lady. Upon conducting your JOG search, you find a crowbar and a ski mask. What would the offence be and how would you proceed from this point?
The answer is They would be arrested for Robbery. You would arrest, caution, necessities and cuff the two individuals. And finally call CWUN for a van (S9)
