What is the purpose of the legislative branch?

A
  • In charge of proposing and passing of certain laws
  • Mostly in charge of policies, not bold laws
  • Is influenced by all of the other branches (Executive, Administrative, and Judical)

-Relationship between legislative and executive is different depending on the state

A
  • In charge of implementing the laws
  • Upholding the laws that come out of the legislative branch
  • In charge of making sure things are executed

What is the purpose of the Administrative/Bureaucratic Branch?

A
  • Day to day responsibilities of implementing the laws
  • In charge of making sure the government functions
  • On a day to day basis making sure that all the policies and laws in society function properly

What is the purpose of the Judicial branch?

A
  • In charge of judicating and applying the law
  • Courts, judges, in charge of making sure citizens, states, corporations, anyone in the state follows and abides by the law
  • Making sure the laws that are created adhere to the constitution and make sure people follow the constitution
  • Judiciary doesn’t make laws or rewrite laws

Separation of Powers and Fusion of Powers

A
  • In the american system, the legislative function is performed by the congress. And the executive branch is performed by the administration. The fear is that if the two powers were no separated, you would end up with a Monarchy.
  • The US government split up the powers so one branch doesn’t take over (Check and balance)
  • As for the Canadian government, the party with the most members elected into parliament leader, is the prime minister of Canada. And when ever the prime minister proposes a new law, the party (being the majority of the house) would most likely vote therefore always passing the laws.
  • Our head of state is actually our queen, or our governor general.
  • The US head of state is the President
  • The leaders have the ability to veto, but that would make the government look non-functional
  • Everything from national defences, international trade, taxes, school board administrations, roads, administration of a company is the Administrative portion of the state.
  • If you don’t have administrators working with the judiciary to make sure the country functions properly, it will be difficult to run.

What is a state?

A
  • State can be territory
  • Sovereign
  • States came up in the 1600’s after the treaty of Westphalia was signed
  • Everything that is not the private realm (Family, economy, or society)
  • Most people agree that the state is in charge of making and implementing political decisions
  • States is the highest order in protecting the community from internal and external threats
  • Analogy: The state is a the driver of a car, but every state has different cars whether thats the engine, the design, the speed, the breaks, but at the end of the day. They are all cars (states). When elected into power, you can modify parts of the car (state), and if its too drastic, then there will be a revolution.
  • Radical ideologies are people looking to change the car (state government)
