Do I need to have an asbestos survey/test prior to any demolition or renovation?

A

YES!

An asbestos survey report signed by an asbestos consultant is required prior to any demolition or renovation. See Rule 1403

The ONLY EXCEPTION to the survey requirement is renovation activity of residential single-unit dwellings (houses) in which less than 100 (10x10) square feet of the surface area of intact (not damaged) material is removed or stripped.

Was the use of asbestos banned?

In what year was asbestos banned?

A

The majority of asbestos-containing building materials was NEVER BANNED.

The EPA announced a phased-in ban of most asbestos products, but it was NEVER IMPLEMENTED.

Asbestos has not been banned and is still in use in some USA industries as well as some other countries.

Can anybody remove asbestos from a building if there is less than 100 square feet of asbestos present?

A

NO!

Only asbestos removal contractors listed at The Cal/OSHA Asbestos Registration are allowed to remove asbestos in the State of California.

Exception: Only to the legal owner of the single-unit family dwelling (house) who is a permanent resident of this house and is personally performing this house renovation themselves (not employing a contractor or laborer, and not being helped by friends, family or anyone else).

REGARDLESS OF THE DATE of the building construction, and because of potential unknown renovations, Rule 1403(d)(1)(A) requires an asbestos survey report prior to demolition to determine and verify the absence or presence of asbestos.

Insurance testers say they will not do any asbestos testing on a property built after a specific date. Do I have to do a survey regardless of the age of the building?

A

YES!

A survey is required regardless of the age of the building. There is no date when asbestos in building materials was banned.

A pipe has burst in the wall and water is flooding throughout my house. Do I need to submit a notification before the plumber opens up the wall to repair the pipe?

A

NO

No notification is required prior to addressing a hazardous situation that is currently happening.

*Recommendation to turn off the water then test before demo.

More info: Once the immediate hazard has been addressed, the site must be secured, stabilized, and surveyed for the presence and condition of asbestos-containing and asbestos-contaminated materials.

If asbestos-containing materials have been disturbed or damaged as a result of, or as part of the response to, the hazardous situation, a Procedure 5 (Approved Alternative) clean-up plan must be submitted and
approved prior to asbestos clean-up.

A

Procedure 5 is a REPORT PLAN that is necessary when asbestos has been DISTURBED.

Do people like p5’s?

A

HELL NO.

Generally, the water damage company or plumber has exposed the asbestos before an inspection was done. This triggers the need for the p5 plan to move forward.

The p5 plan is expensive and can be the financial responsibility of the company that disturbed the asbestos.

How many asbestos samples do we take?

A

Generally about 3 samples for each homogeneous area.

What is a homogeneous area?

A

A homogeneous area is basically an area where all the MATERIAL IS THE SAME.

Example, drywall is 1 area and flooring would be another. So we would take 3 samples of both for a total of 6 samples.

What can happen if companies don’t test?

A

Aside from LARGE FINES of 30-60k per day.

The company can be HELD RESPONSIBLE by the homeowner for damages if hazardous materials are found.

Example: A company we know in OC just had to pay 70k to replace all furniture at a HO property because they exposed it to asbestos without testing.

A

4 different agencies…

EPA,
Local Air Quality Management Districts,
OSHA,
NESHAP

Regulate the emissions, removal, and disposal
of asbestos.

Who regulates lead?

A

4 DIFFERENT AGENCIES

HUD,
CDPH,

All have many regulations that protect the public and children from lead exposure

Fine for asbestos?

A

In California $25,000 maximum or $10,000.00 per violation.

Fines for lead?

A

Anyone who will disturb lead in a property built before 1978 must be in compliance with the EPA RRP certification or you may look at fines leading up to

$37,500/ PER DAY!

Sewage fines?

A

Fines can be incurred for improper disposal
of wastewater with both the city/ county and regional
water board.

Fines can range from $30,00 or $1,000 per gallon

What is a 1000 point count?

A

This is done when a job comes back equal to or <1% in California. The 1000 point count takes a more in-depth look at the samples and is a more expensive process than the initial testing.

<1% = Clean Trash BUT Abatement Certification required.

<0.1% = Clean Trash and (Water Damage Co) General Construction Safety Protocols provided the employer gives worker tailgate training, and optional respirators.

When during the process is testing be performed?

A

Asbestos & Lead: Pre demo (initial) & post demo (clearance)

Mold: Pre & Post (Pre is not normally done because it’s obvious if moisture is present.)

What is a clearance?

A

A clearance is needed to determine if an area has been properly remediated and no hazardous materials are present. This is done while the containment its still up.

What does a laboratory do?

A

A laboratory does the actual inspection of the sample. Some testing companies have their own lab but YGM does not.

How is an asbestos sample taken?

A

A small triangular piece is cut out of a discrete area so that a limited amount of damage is created. Somewhere like behind a light switch plate.

A

CSST (Certified Site Surveillance Technician)

Is testing covered by insurance? If so, when is it not?

A

In most cases yes for asbestos and lead. For mold it depends if the policy has mold coverage.

A denied claim for things like long-term damage or when a client doesn’t have coverage.

What is VFT?

A

VFT is vinyl flooring tile.

What is Mastic?

A

Mastic is an adhesive that, along with thin-set mortar, is used to stick tile to wall or floor surfaces before grouting. Is can contain asbestos.

A

3 Per Homogeneous area.

A

How fast can we get results on a mold clearance?

A

Mold clearance is done on-site via air samples unless specifically asked for surface samples (Usually they don’t).

Results are ready about 3 hours after inspection.
