What does Section 15 of the Search and Surveillance Act 2012 refer to?
Warrantless power to enter a place to find and avoid the loss of evidential material relating to certain offences “Offence punishable by imprisonment for 14+”
If you have RGTS an offence punishable by imprisonment for 14+ years has been/is being/about to be and RGTB that EM related to the offence is in a place and may be CADD
What does Section 16 of the Search and Surveillance Act 2012 refer to?
Warrantless power to search people in a PP for EM relating to certain offences
- Person is in PP and you have RGTB the person is in possession of EM relating to a certain offence (14 years +)
What does Section 17 of the Search and Surveillance Act 2012 refer to?
Warrantless power to enter and search a vehicle for EM relating to certain offences
- Vehicle in a PP and RGTB that EM relating to a certain offence (14 year +) is in the vehicle
What does Section 116 of the Search and Surveillance Act 2012 refer to?
Securing place, vehicle or thing to be search
If search is being carried out, you may
- Secure place/vehicle/other thing
- Any area in that place
- Any thing found in that P/V
AND
- Exclude any person if you believe they will obstruct/hinder the search
What does Section 118 of the Search and Surveillance Act 2012 refer to?
Power of detention, incidental powers to searching places and vehicle
You may detain any person to determine a connection
- Any person found at the P/V
- Any person that arrives at P/V
- Any person stopping at/entering P/V
