What is the relationship between sport and the law ?
- normally considered separate
- Due to an increase in deviance in sport - these now overlap
- Increased levels of professionalism and commercialisation in sport has led to a stricter adherence to legal standards
- performers, officials, coaches and spectators considered
How is the performer affected by the law ?
- injuries can be deliberate acts from others
- There have been criminal cases due to dangerous tackles which have resulted in career ending injuries
- E.g. Matt Holmes was a professional footballer who claimed damages for a career ending tackle
What is negligence ?
- conduct that falls below a reasonable personal standard
- this leads to a breach in duty of care
- results in foreseeable harm to another
What is a duty of care ?
- A legal obligation imposed on someone if they are responsible for a group of people
What is an example of a duty of care ?
An official who fails to take reasonable care for another person.
In rugby if an official has been at fault for injury if the scrum keeps collapsing and nothing has been done to resolve the issue
How do coaches have a duty of care ?
Health and safety:
Coaches are responsible for athletes in their care. Making sure their are access to first aid facilities
Protection from abuse:
Protect children from emotional and physical abuse. Organisations should have a policy statement and guidelines on this.
Supplements:
Educate their athletes about drug use and provide appropriate advice on legal nutrition to enhance performance
Duty of care:
In charge of safety ad welfare. Includes medical details, contact numbers, first aid, DBS and risk assessments.

How does sports legislation affect spectators ?
- must act within the law (public order acts)
- illegal to trespass onto the field of play
- Illegal to chant in a racist manner
What are the measured that ensure safety and overcome hooliganism ?
- increased security
- specified kick off times
- tougher deterrents
- control of alcohol sales
- removal of perimeter fences and terraces - now all-seater stadiums
What are the 6 legislation acts that try to control fan behaviour ?
- Occupiers liability acts
- occupier of a premises owes a common duty of care to their visitors - Safety of sports grounds acts
- protects all spectators - Sporting events (control of alcohol)
- bans possession of alcohol at a match or on the way to a match
- no alcohol sold during a match - Fire safety and safety of place of sports act
- A fire security certificate needs to be gained from the local authority
