Specific Intent Flashcards
Specific Intent
where is specific intent found
Specific Intent the statute will list the word “intent” and what that intent is or the objective is.
it is **more than merely doing **the act.
1 or 2 reasons significant intent is important
proof of specific intent
not just the mere desire to commit the act
1) Need for Proof
the prosecution must produce evidence **tending to prove **the existence of the specific intent.
look to the manner in which an act was done may provide circumstantial evidence of intent.
EXAMPLE
A shoots B. The fact that A shot B does not show that A had the intent to
shoot and kill B. However, if A bought a revolver and ammunition shortly before shooting B, carefully loaded the revolver, took careful aim at B, and fired several times, that evidence may circumstantially prove A’s intent to kill B.
