Marxists approach to crime and law
Marxist see power being held by the Bourgeoise and laws are a reflection of Bourgeois ideology.
Selective Enforcement
Police, authorities. The legal system
(lawyers, judges and courts) and the police all serve the interests of the Bourgeoisie, give most their attention to the working class. Police and courts tend to ignore the crimes of powerful whereas powerless groups e.g working class + ethnic minorities are viewed by them as criminals.
The law is made by the capitalist elite, what does this mean?
This means that capitalist elite made laws which tend to work in their favour? Capitalist have made some ideological functions which convince proletariats that capitalism is a good system, when capitalist just prioritise from them.
Examples of laws that work in the favour of the capitalist elite?
Minimum wage, means no exploitation for the working class, sets a very low wage meaning the bourgeoise are able to minimise their wages to employees by paying them the least they legally can.
NHS, means free health care for the working class and no health insurance and healthy workers, this means that capitalist businesses are able to make profits.
Holiday pay, means 4 weeks off paid for the working class, this means that capitalist businesses will benefit from employees having increased motivation as well as being healthy and also having increased productivity, this means more profit for the business.
Sick pay, means if employees become ill they are still able to pay bills, this cost is not paid by the government.
