What right do we use against those who violate natural law?
We have a natural right and duty to punish those who violate the natural law. Especially when they violate the rights of others particularly the weak.
Do we have the right to act in self-defence?
Yes, under natural law we have a right to defend ourselves against those trying to violate our rights.
Why is punishing violators of Natural Law problematic in a State of Nature?
There is a problem of partiality, and this may lead to disproportionate punishment.
What are the two stages of the Social Contract?
Political community - unanimous between individuals to create community.
Government - between the community and the government.
What power can we not give our rulers?
We cannot give them any powers we do not possess under the Law of Nature.
The Law of Nature gives nobody absolute and arbitrary power, so we cannot give this to a government.
What are the first 3 rules of the Social Contract?
We trust rulers with the powers they need to perform their limited functions.
Consent is given on terms the rulers must keep, it is conditional.
Government must serve the common good according to God’s design and the Law of Nature.
What are the last two rules of the Social Contract?
The contract is revocable - the people never relinquish their full authority.
There must be a separation of powers - no unique formula but the legislative is predominant.
