- Relatively fast, cheap and easy
- No need for solicitor
Small Claims Procedure
Claims up to the value of €2,000 for:
- Faulty goods
- Damaged property
- Poor-quality production
Step 1: Application
Consumer submits application form outlining the complaint and amount being claimed
Form is sent to local District Court with a small fee
Step 2: Small Claims Registrar
organises a meeting with both parties to resolve the dispute. If the dispute cannot be resolved then the case is referred to the District Court
Step 3: Referral to the District Court
Judge listens to all witnesses and makes a decision, which can include:
- Awarding the amount claimed
- Ordering goods be repaired or work be finished
- Awarding financial compensation
4: Appealing a Decision
An appeal can be made to the Circuit Court within 14 days of receiving the judgement
