What is disclosure?

A

The stage in the proceedings where the parties must inform each other od documents that they have which are relevant to the claim, as ordered by the court.

What is the general rule for disclosure?

A

A party must disclose those documents that it has or has had under its control that it intends to rely on or which adversely affect its own.

A party discloses them by specifically describing the min a list.

What are the tw ostages of disclosure?

A
  1. Disclosure under CPR 31.2; and
  2. Inspection under 31.3 (allowing the other side the opportunity to inspect the content of those documents or take copies)
