Professional misconduct of sexual nature is defined as:
- sexual intercourse, or other forms of physical sexual relations between practitioner and patient
- Touching of sexual nature OF the patient BY the practitioner
- BEHAVIOUR OR REMARKS OF SEXUAL NATURE, BY THE PRACTITIONER TOWARDS THE PATIENT
If a practitioner is guilty of sexual misconduct, they will be reprimanded by:
- paying fines
- lose the right to practice for period of time or indefinitely
Does the prohibition against sexual misconduct apply only to patients?
Yes.
It does not apply for practitioner to practitioner
When must a practitioner report sexual misconduct buy another healthcare provider?
- the practitioner has reasonable grounds to believe the other healthcare provider engaged in sexual misconduct
Where must a report of sexual misconduct be submitted?
- sent to register of the college, to which alleged offending practitioner belongs.
Report must be made in writing.
Report must include reporting practitioners name, and the grounds to report
Can a report of sexual misconduct contain the patients name?
No.
However, the patient could agree in writing that their name could be included.
Is a mandatory report required if a practitioner, overheard another practitioner, telling two male patients a sexually explicit joke, who laughed loudly?
Yes. This constitutes sexual misconduct.
