When are they used?

A

If the patient has no representative or subsitiute decision maker and is INCAPABLE of making informed consent.

The office of Public Guardian and Trustee will appoint a decision maker

A

CFCSA (Child, Family and Community Services Act)

What do they do?

A

If a child is in need of protection we must contact CFCSA.
Their duty overrides all privacy and confidentiality laws
.
No legal action can be taken against practitioner for reporting
.
If we do not report we are subject to a fine of $10K and upto 6 months imprisonment

A

This is the Act that is used in Public Hospital and applies to a health care practitioner who works for the public hospital.

HCCCFAA (Health Care Consent and Care Facility Adminsitration)

A

They prohibit any health care pratitioner from providing care without consent.

The also set the standard for the ranking substitute decision maker if the person is incapiable of consenting

They create the statutes that practitioners will have to be MOST aware of

HPA (Health Professionals Act)

A

Provides a framework for:
governance
registration
restricted activities
discipline
competence.
.
The college serves and protects the public under HPA.
.
HPA allows the college to create bylaws for:

  • Ethics
  • Standards for avoidance of conflict of interest
  • Professional misconduct
  • And with respect to the regulation of the profession
    .
    “Umbrella” statue that sets out duties and responsibilities of Minster of Health Services

Human Rights Code

A

Persons with disabilities be accommodated

  • No mandatory reporting requirements under HRC
  • protects equal treatment of patients regardless of race, gender etc.
  • if HRC is violated, practitioner or organization may have to pay damages or undergo more training
  • Human Rights Tribunal does NOT have the right to suspend or revoke the practitioners certificate of registration

HR is used for scenarios where persons needs wheelchair, offer more time for learning disabilities, service animal, communicate in writing if they have hearing impairment etc….

Labour Mobility Act

A

Three provisions under this act that allow for out of province, registrants, from elsewhere in Canada, to transfer to BC with recognition of their qualifications.

the only registration requirements. The college of BC can review are good character and professional liability insurance.

A

helps guide the general duty of confidentiality to protect the privacy of patient’s personal health information under college bylaws, and the PIPA act

PIPA requires an appointed contact person called the information officer. The officers duties are to ensure private practises are compliant with PIPA
