Appointment power of president
- Power to appoint ambassadors, judges and all other heads of the cabinet. Is th only person who can appoint people with regulatory power.
- Congress can appoint inferior officers and the inferior officers can be committee members
Pardon powers
can pardon for only federal offenses
commander in chief
has the power over any of the armed forced EXCEPT for declaring war
enter treaties for pres?
Sometimes the treaty can conflict with fed law. Which prevails? Whichever is newer
Removal power
If you see anything about removing someone from office the president has that power
Executive order and agreement
- Order is anything that is within the uS
- agreement is anything with a foreign country
- Cannot conflict with or expand fed law
Congressional power
- Taxing and spending
- commerce clause
- War
- Foreign affairs
- aliens
- coin money
- fed land
- delegate powers to the president
- necessary and proper
Taxing and spending power?
Tax - When it raises revenuer for the general welfare, but, cannot ACT in the general welfare
Spend - Can appropriate money so long as it is for general welfare
Commerce clause for congress
Congress can pretty much do anything so long as it is regulating biz
Look for anything about selling, distribution, manufacturing, etc. of a widget
War power congress
Congress has the power to declare war and do whatever is in need to provide for the defenses of the country
Foreign affairs
Congress has the primary authority over foreign affairs
aliens
has the power to regulate aliens
coin money
congress has the right to coin money
