A

Circumstances surrounding the commission of an offense that make it more or less serious.

Example: The more fraud docs the more serious the charge gets.

What is cross reference?

A

Due to the circumstances surrounding the commission of some crimes, the sentencing guidelines may direct that one category of crime be sentenced like a different category.

Example: A alien smuggler has a group of 10 and one dies, the crime now moves up to a murder charge.
