What is security of tenure under the Landlord and Tenant Act 1954?
Business tenants have the right to remain in occupation and renew their lease unless excluded under s.38A LTA 1954.
Landlord can only oppose renewal on statutory grounds (s.30 LTA 1954).
What are the grounds under s.30 LTA 1954?
✅ Mandatory grounds:
(d) Landlord has offered alternative accommodation.
(f) Landlord intends to demolish or reconstruct and cannot reasonably do so without possession.
(g) Landlord intends to occupy for own business or residence.
✅ Discretionary grounds:
(a) Failed to repair.
(b) Persistently delayed paying rent.
(c) Substantially breached other obligations.
(e) sublease preventing disposal of whole property.
What compensation is available if renewal is refused?
No fault grounds - (f), (g), (e)
Standard compensation = one times the rateable value.
If tenant has occupied for 14+ years = twice the rateable value
