What are the duties of the client?
- To appoint and agree contractual terms with the architect.
- to express and communicate important and relevant informations.
- To abide by CDM 2013 legislation

What are the duties of the architect?
- To Act with competence and use the required knowledge competently
- To Act with diligence and provide the client with a Duty of Care
- To be integral and honest when communicating advice and ideas

- To Act on the clients behalf
What is it called when the law of tort is breached?
Tort of negligence
What is Tort of negligence?
When the Duty of Care for the client is disregarded and the client or client belongings become damaged
What is the Law of Tort?
Law of Tort covers all civil wrongs outside of the Contract Law that cause Loss/ Damage to the client or properties of the client
What is an express contact?
A contract where the client specifically appoints architect in writing or orally.
This confirms a standard form agreement making the Architect officially the clients agent.
What is an architects 2 responsibilities in regards to the Contract?
- the architect is directly liable in Contract under the terms stated in the Contract/ appointment (contract law)
- the architect is indirectly liable in agency under the standard form agreement (RIBA)
What is the RIBA standard conditions of appointment?
This is a contract that establishes and outlines rights and imposes obligations on both party members bound by the law.
