Probable Cause
Reasonable likelihood based upon known facts
Why probable cause?
To balance the privacy and possessory interests of the people against the legitimate governmental interests in law enforcement
Exclusionary Rule
Evidence obtained in violation of constitutional principles may not be used in a criminal trial
Fruit of the Poisonous Tree
Illegally obtained evidence may not be used at trial to prove guilt
Sufficiency of Warrant/Nexus
- Criminal activity(ies)
- thing(s) to be seized
- place(s) to be searched
No knock search warrant reasons
Danger futility? destruction of evidence
Four exceptions to warrants
- Search incident to arrest
- vehicle search
- exigent circumstances
- consent
Search incident to arrest
- Lawful arrest
- Contemporaneous with arrest
- With-in suspect’s immediate control or grab area (wingspan)
Auto Search Exception
- PC to believe vehicle contains evidence of crime

Exigent circumstance
- Hot pursuit
- Destruction of evidence
- Emergency Aid
- Inventory Search
Destruction of Evidence
- Imminent danger of being destroyed (fact that evidence can be easily destroyed is insufficient)
Emergency Aid
- Emergency threatening life or safety of another
Must have more than “theoretical possibility” of emergency
a. Immediate crisis
b. Probability police assistance would be helpful
Inventory Search
- After impound
- Includes closed containers inside vehicle
- Must be standard policy
Consent
- Freely and voluntarily given
- Consenter must have authority or reasonably appear to
(Common or apparent authority) - Must be with-in scope of consent
Common Authority
- Jointly owned and mutually used (who pays the bills?)
