Causes of conflict…
> Disputes relating to the negotiation of awards or agreements (I.e remuneration)
Disputes relating to outside awards or agreements (I.e physical work conditions)
What is protected industrial action?
Refers to action taken by either party to a dispute that has been approved by the Fair Work Commission. For example, a strike or a lockout.
What is unprotected industrial action?
Refers to action taken by either party to a dispute that has not been approved by the Fair Work Commission. These actions can be resolved if the FWC uses conciliation or arbitration. For example going on an unnoticed strike.
What are the ways to resolve conflict?
> Negotiation > Mediation > Grievance procedure > Conciliation > Arbitration
What is conciliation?
When a third party participates in the resolution of a dispute by trying to discuss the problems and how they can be solved.
What is arbitration?
When a judge or a panel of judges hear both arguments from either party in a formal court like setting and the judge determines the outcome.
What is negotiation?
Where discussions are held between the parties so that a compromise may result aswell as a formal or informal agreement about the dispute.
What is mediation?
When the two parties discuss the issues regarding the dispute with a mediator. A person who is neutral and just there to keep the peace.
What is a grievance procedure?
A grievance procedure is an orderly system where the employee and employer can resolve disputes by making complaints to management.
What is conflict?
Conflict refers to disputes, disagreements or dissatisfaction between individuals and/or groups.
