Section 85
Search arrested/detained to prevent harm/escape
Section 88
Search arrested/detained if RGTB that person has the evidence related to arrest OR to prevent harm/escape
Section 11
Custody search at Police Station/ Premises/ Car.
After the lock up, if the person hasn’t been searched OR was close to another person that hasn’t been searched
OR RGTB this person has something that can harm another person.
Section 13
All property taken while in custody should be returned unless:
- it is an evidence
- it is an offense to have this property
Section 16
You can search person in a Public place if you have a RGTB that person has an evidence for 14+ offense.
Section 119
Search a person who at/arrives at/stops at/enters/tries to enter a place or vehicle if you have RGTB that this person has an evidence or dangerous item that is a threat and thus immediate actions are required.
Section 121 (1)
If there are grounds to conduct a search you may stop the vehicle to conduct the search.
Section 121 (2)
If you are satisfied that warrant is going to be issued, you can stop the vehicle to conduct the search.
Section 128
If car was stopped and/or searched you may require it to remain stopped for as long as required.
Section 122
If vehicle was stopped, but the search is impracticable at that place/for the safekeeping, you can move the vehicle to another location.
Section 123
You can seize an items in a PLAIN VIEW while executing your search powers at any place/vehicle.
Section 116 (1) (a)
If searching you can SECURE area/place/vehicle/items found.
Section 116 (1) (b)
If you believe a person will obstruct, you may EXCLUDE this person from the area/place/vehicle.
Section 116 (2)
If during the search affected person requests, you must identify reason or search/related act/yourself/ID if not in uniform.
Section 118 (1)
To establish the connection between search and person DETAIN anyone who arrives/stops-enters/ at place/vehicle.
