What is RAP?

A

“No interest is good unless it must vest, if at all, not later than 21 years after some life in being at the creation of the interest”

What is the purpose of RAP?

A

to curtail the “dead hand” control of wealth and to facilitate the marketability of property. Courts reasoned that after 21 years, current owners of the Possessory Estate should be free to use the property as they wish/ best interest for society.
