Causes of impairment
- Alcohol
- Drugs
- Medical factors such as diabetes
- Other factors such as mental state, fatigue
Sources of evidence used to establish good cause to suspect
- Driving observations weaving/headlights/stopping
- Driver observations slurred/bloodshot/flushed
- Witness evidence
- Other observations view/smell drugs
- Questions to test attention
- Eliminate alcohol via EBA and medical/driver factors
Compulsory Impairment Test (CIT)
- Eye assessment
- Walk and Turn test
- One leg stand
If test is unsatisfactory, blood sample request
Requirement to Undergo a Compulsory Impairment Test (CIT)
Section 71A details who an enforcement officer may require to undergo a CIT, once ‘good cause to suspect’ has been established.
Require to Remain/Accompany
“I now require you to remain/accompany me to the ___ Police Station or other such place for the purpose of a Compulsory Impairment Test, blood test or both”.
Refusal to Remain/Accompany
If the driver is uncooperative and refuses to remain or accompany he/she should be arrested for Refusing to Remain / Accompany. Once back at the Police Station the CIT procedure should continue. RAN
