What are your powers under Section 114 of LTA?
- Power to stop vehicles (15min max) and demand driver details. Name address DOB etc and car owner details.
- Power of arrest without warrant 114(6) any person who fails to stop, refuses to give details, supplies false details.
What are your powers under Section 113 of LTA? DIMDFFD
- Power to enforce provisions of specific transport legislation.
- DIRECT a person on road to give identity details
- INSPECT, test, examine any part of vehicle or docs
- MOVE the vehicle causing obstruction
- DIRECT the vehicle to be moved causing obstruction
- FORBID unlicenced driver to drive
- FORBID transport operator not to drive
- DIRECT person using vehicle/riding animal to stop or pedestrian
When do you use Section 114 of LTA?
To stop vehicles only to enforce LTA or other traffic-related Act/regulations.
Cannot be used to stop drivers acting suspiciously.

What are your powers under Section 115 of LTA?
- Power to prohibit vehicles from being driven
on a road (green/pink sticker)
What are the differences between a green and pink sticker S115?
POL 650 GREEN = DEFECTIVE fails to comply with regulations or rules eg defective exhaust
POL 555 PINK = UNSAFE not in a safe condition to be driven on a road eg illegal modifications/structural rust.
What are your powers under Section 118 of LTA?
- Demand driver details from owner / hirer
- Committed any offence, any act
- 14 days to provide details
- Immediately if fleeing driver S118(4)
What are your powers under Section 119 of LTA?
- Power of entry to carry out breath alcohol testing
- Fail to stop + Manner / speed / drink driver + fresh pursuit
- Enter by force if necessary to carry out EBA procedure
What are your powers under Section 121 of LTA? FARMED
- Powers to take keys and forbid driving FORBID for specified time ALL keys surrendered RENDER vehicle immobile MOVE the vehicle EBA driver forbid for 12 hour DIRECT person to place of rest

What are your powers under Section 122 of LTA?
- Power to seize vehicle for 12 hours
If you beleive on reasonable grounds, in the interest of public safety, you can seize and impound a vehicle for 12 hours. LAST RESORT provision.
Why would Police suspend a persons driver licence under S95 of LTA?
28 day suspension drivers licence / over limit / 40kph over perm limit / 50kph over temp limit
When must Police impound vehicles under S96 LTA?
28 day impoundment vehicle
eg disqualified driver
Demerit points;
- If in a 2 year period, a person accumulates 100+ demerits, NZDL suspended for 3 months
Difference between an unsafe and defective vehicle?
Unsafe = not in safe condition to be driven on road = illegal modifications = structural rust = POL 555 Pink Sticker
Defective = fails to comply with regulations = defective exhaust = tinted windscreen = POL 650 Green Sticker
