What powers do you have under section 114 of the LTA 1998?
Require a driver to stop and give details.
What must you be wearing to stop a vehicle?
You must be in a uniform or wearing a cap/hat/helmet displaying a badge of authority
If you are in a car, in uniform or plain clothes, what can you do to stop a vehicle?
- Display flashing blue lights or blue and red lights.
- Sounding a siren
What details can you demand a driver to tell you?
- Full name, address, date of birth, occupation, phone number (or such of those particulars as the enforcement officer may specify)
- whether they own the vehicle
- the name and address of the owner or any knowledge that will lead to the identification of the owner.
How long can you keep a driver stopped for?
You can keep a driver stopped as long as reasonably necessary to obtain details or exercise another power in this act.
If the sole purpose is to establish identity - up to 15mins
When can you arrest a person without warrant under Section 114(6) LTA 1998?
If they
- fail to stop
- refuse to supply details
- supplies details that you have good cause to suspect are false or misleading.
When can you use Section 114 of the LTA 1998?
If you are enforcing the Land Transport Act 1998 or any other traffic related Act or regulation.
