What is the VLRC?
The Victorian Law Reform Commission (VLRC) is Victoria’s leading independent law reform organisation, which reviews, researches and makes recommendations to the Victorian Parliament about possible changes to Victoria’s laws.
Main aim of the VLRC?
It aims to ensure that the legal system meets the needs and aspirations of the Victorian community
Enabled through which act?
the Victorian Law Reform Commission Act 2000 (Vic)
roles of the VLRC
- Make law reform recommendations on matters referred to it by the Attorney-General
- Make recommendations on minor legal issues of general community concern, without reference from the AG
- Suggest to the AG that he or she refer a law reform matter that is in need of investigation to the commission
- Monitor and coordinate law reform activity in Victoria
- Undertake educational programs on any area of the law relevant to its investigations or references
What are terms of reference?
Instructions given to them to investigate an important matter.
Terms of reference set out the precise scope and purpose of the inquiry and the date by which the final report must be completed.
Process of the VLRC
1. Before conducting an inquiry, they require terms of reference from either AG or will be drafted by the VLRC
2. Publish a consultations/issue paper (explains key issues & develops key questions) and call for submissions from public
3. Public participation: Extensive
consultation with affected parties and interested members of the community. Submissions received and considered
4. Publish a final report: include recommendations for reform
5. present final report to AG who will then table it to Parliament within 14 sitting days. Gov will decided whether to implement some or all but not bound to do so
