advantages of judicial precedent

A

Certainty- Lawyers can advise on how the court may handle a case and it’s outcome. This is beneficial as it means they can decide whether they think they may win a case or not.
Consistency- Using precedent it allows cases with similar fact to be treated a similar way. This creates consistency in court.

A

The Parliament can make laws concerning anything.

A

Allows court to see the purpose of the law when interpreting the statute

Advantages of purposive approach

A

It gives effect to Parliament’s Intentions. It makes sense to look at the purpose of an act.for interpreting it. For example, in Jones v Tower Boot, some may say the intention of parliament was to stop racism at work, even if it was not explicitly said.
