What are the elements of robbery?
Theft Accompanied by violence OR Accompanied by threats of violence To any person OR To any property Used to extort the property stolen OR To prevent or overcome resistance to the property being stolen
What are the three factors to make it aggravated robbery?
A person robs any person and at the time or after the robbery causes GBH to any person
Being together with any person or persons Rob any person
A person armed with an offensive weapon or instrument (includes firearm) robs another person
What has to happen for robbery to occur?
Theft must occur
What is assault with intent to rob?
Assaulting someone with the intent of robbing them
What is demanding with intent to steal?
Any person with menaces or by any threat demands any property from any person with intent to steal it.
What is to prevent or overcome resistance to the property being stolen?
Using force or incapacitating someone to stop them stopping the robbery from occurring
What is “Used to extort the property stolen” mean?
Extort is to obtain by violence or intimidation or to extract forcibly.
The violence must be used to steal the property.
Explain “to any person or property”
Any person means the person being robbed or anyone else.
Threat to property means any threat to property e.g. give me your wallet or I will smash you
What is “accompanied by violence”?
Robbery is committed if violence is used on the victim at the time of theft to commit the theft
Explain “threats of violence”
Is fear enough to be a threat? E.g. a gang member with a patch on
A threat of violence by words or conduct to compel the property to be given over.
