When police want two parties to seperate but not enough evidence to arrest.
What are the standard conditions of a PSO?
Mirrors standard conditions of a protection order

What is the maximum time a PSO can be issued for?
10 days
Define a qualified Constable
Sergeant or higher
What are the powers to detain someone in relation to serving a PSO?
What are the restrictions if these powers?
May detain for 2 hours and hold them til the order is served or two hours passes.
Can arrest if they fail to remain under S32(2)(6) FVA 2018.
Does consent have to be given by the person at risk for a PSO to be put in place?
No
What duration of time do you have to serve an issued PSO before it lapses?
48 hours

What action is to be taken upon breach of a PSO?
Take the person into custody using force if necessary (they are not arrested)
What timeframe must they be bought before a court for contravening the PSO?
24 hours, if not possible must be released and summonesed
What is the courts options when dealing with a breach of PSO?
Direct police to issue another PSO
Allow a judge to decide if a TPO is needed.Can be detained for 2 hours as well for this to happen
Who must be informed of the courts decision and subsequent action?
The person at risk (PAR)
When can you arrest someone in regards to a PSO?
Fails or refuses to remain at a place they are detained
When the bound person breach’s and police apply to the court for a warrant to arrest (also provides a entry power)
