s.8 Theft Act 1968
A person is guilty of robbery if he steals, and immediately before or at time, and in order to do so, uses force on any person or puts or seeks to put any person in fear of being then and there subjected to force
Theft
Theft must be complete - robinson
Waters - no robbery as no intention to permanently deprive
Theft complete on appropriation - corcoran v anderton
Force
D must use force or fear of force - jury to interpret
R v Dawson & James - nudge enough
B and R v DPP - not if V scared, must apprehend force
Can be property - Clouden, bag off shoulder
P v DPP - not cigarette snatch
“Immediately before or at time of doing so” appropriation as continuing act - hale
Force to escape - lockley
Any person - smith v desmond
Mens rea
Mens rea of theft needed - dishonesty and intent to permanently deprive
Must have intent to use force - if force is accident no robbery (forrester)
