Robbery defintion
-Under s 8 of Theft Act 1968 says:
-A person is guilty of robbery if he steals, and immediately before or at the time of doing so, and in order to do so, he used force on any person or puts or seeks to put any person in fear of being then and there subjected to force.
Actus Reus of Robbery
-Element that must be proved for robbery are: Theft and Force or putting or seeking to put any person in fear of force
-Two conditions on the force:
1. It must be immediately before or at the time of the theft. Considered in R v Hale and R v Lockley
2. It must be in order to steal. Corcoran v Anderton
There must be force or threat of force
-Amount of force can be small, R v Dawson and James
-The victim does not have to fear the force being threatened, B and R v DPP
On any person
-Force threatened does not need to be on the person who is being stolen from
Mens Rea of Robbery
Two elements, Defendant must have:
-The Mens Rea for Theft
-Intended to use force to steal
