what is the definition of robbery?
‘he steals, and immediately before or at the time of doing so, and in order to do so, uses force on any person or seeks to put any person in fear of being subjected to force’

what 5 areas cab robbery be split into?

what is ‘theft’?
‘the dishonest appropriation of property belonging to another with the intent to permanently deprive’
all 5 elements must be satisfied.
what case example can be used for ‘theft’?
Concoran v Anderton - D knocked V to the floor to take her handbag. V managed to hold on and D ran away empty handed. Guilty.
what is ‘force’?
D just used force or threaten force. Must modify V’s movement.
what case example can be used for ‘force’?
Dawson and James - Ds jostled V to pickpocket him. Guilty.
what is ‘timing’?
the force must be immediately before or at the time of the theft.
what case example can be used for ‘timing’?
Hale - 2 D’s, one tied V up and the other stole jewellery. As the force was happening while the theft was, both Ds were guilty.
what is ‘purpose’?
the force/threatened force must be to steal only.
what case example can be used for ‘purpose’?
Donaghy - D threatened a taxi driver into taking him to London, stole money once there. Not guilty of robbery as the original threat wasn’t to steal.
what is the mens rea for robbery?
D must have the:
1. intention to steal
2. intention to use force/threaten force
