Section 8 Theft Sct 1968 - guilty of robbery definition
‘a person is guilty of robbery if he steals and immediately before or at the time of doing so, and in order to do so, he uses force on any person or puts or seeks to put any person in fear of being then and there subjected to force’
Steal
Normal meaning under sct 1 Theft Act 1968
Immediately before or at the time of doing so
No unbroken chain of events - immediately before can apply still
Force can be applied at the time of the theft - using force before or at the time of and in order to steal makes the offence complete
In order to do so
In order to commit theft - use of force or threat of force
Uses force on any person
Intentionally or recklessely - not necessary to use force, but that it was threatened
Puts or seeks to put, any person in fear of being then and there subjected to force
Offence doesn’t require a victim in fear - the intention needs to be present
Threat does not need to be directed at the person who has the property, you cannot fear for another
