Overarching principle of urgent duty driving:
Public and Police employee safety takes precedence over the necessity to undertake UDD
Additional principles for UDD?
- Safety prioritised

What is a critical incident?

When can a tactical approach not be used?
When a fleeing driver incident is initiated
Fleeing Driver: Overriding principle when applying TENR?

What must TENR balance regarding fleeing drivers?
- initial threat
- necessity to immediately apprehend
- Risk of harm to any person
What will be considered when fleeing driver event is reviewed?
- Appropriate
- Lawful
- Justified, considering circs
- Compliant with Police instructions
- Lessons learnt
Police powers under Section 113 LTA?
Direct a person on a road to give:
- Name
- DOB
- Occupation
- Phone
Direct, Test, Examine, Move
Police powers under Section 114 LTA?
Signal or Request vehicle to stop.
How long must a driver stay stopped under S114?
As long as reasonably necessary or no longer than 15 minutes if stopped to establish identity and that has been established
What details must driver give if stopped up S114 LTA?
- Name
- DOB
- Occupation
- Phone
- Whether or not they own the vehicle
- If not owner, give name and address of owner
Arrest powers under Section 114:

- failed to comply with Section
- given false or misleading information
What must Police need for entry powers under Section 119 LTA

- Contravened request, requirement or demand under 114 AND
- Has or is committing reckless/ dangerous driving/ driving under influence AND
- is freshly pursuing
Entry powers under Section 119:
- Enter by force if necessary premise person has entered
- In relation to determining whether EBA procedures should be commenced
- Completing the exercise of any power as if person was in a vehicle
Arrest powers under Section 120 LTA?

- committed offence against Section 58-62 (alcohol or drug related) OR assaulted an officer
- does not complete impairment test to officer satisfaction
