1) Grant of probate, 2) Grant of letters of administration (with will), 3) Grant of letters of administration.
What does a grant of probate contain?
Identity and date of death of deceased, confirmation of valid will, identity of executors, estate validity, official signature, stamp, and seal.
When is a grant of probate issued?
Deceased left valid will, will appoints executors, and at least one executor is willing to act.
Is grant of probate needed if will does not dispose of all property?
Yes, still required.
What is power of attorney?
When a named executor formally appoints someone to act on their behalf.
When is grant of letters of administration (with will) granted?
Deceased left a will, but no executors appointed or willing to act.
When is grant of letters of administration granted?
Deceased died intestate (without a will).
Which grant is needed for partial intestacy on gifts?
Grant of probate, as long as executor appointment is valid.
