What must PR do before distributing assets?
Pay debts, funeral costs, and administration expenses.
What is the order of payments in distribution of the will to beneficiaries?
1) Legacies (specific and general)
2) Residuary legacy.
What are interim distributions?
Partial payments to residuary beneficiaries if PR confident assets cover liabilities.
What must PR consider to ensure proper distribution?
1) Identity of beneficiaries
2) Nature of interest
3) Property entitlement.
How must PR examine identity of beneficiaries?
Review will, apply rules of construction, consider class gifts and substitution clauses, or apply intestacy rules.
What are the different types of interest?
1) Vested
2) Contingent
3) Under a trust.
What is method of transfer for chattels?
Physical delivery to beneficiary.
What is method of transfer for cash legacies?
Cheque or bank transfer.
What is method of transfer for shares?
Stock transfer form.
What is method of transfer for land?
Legal assent using Land Registry form AS1.
Who bears the cost of transferring assets?
The beneficiary.
Do beneficiaries inherit IHT?
No, they inherit free of IHT.
When must PR complete administration?
Within a year.
Important dates PR must consider?
1) Trustee Act notice (2 months)
2) IPFDA claims (6 months from grant + 4 months for service).

1) Specific legacies
2) General legacies
3) Residuary.
Order of payment if insufficient funds?
Specific legacies first, general legacies proportionally, residuary gets nothing.
What are specific legacies?
Clearly identifiable items, e.g. ‘my car’.
What are general legacies?
Non-specific, e.g. a sum of money.
If will doesn’t instruct funding source for legacies, where are they paid from?
The residue.
How is residue distributed?
According to will or intestacy rules.
What is appropriation?
PR transfers assets instead of cash to beneficiaries.
Rules of appropriation?
Asset value cannot exceed entitlement; PR tops up with cash if needed.
What must PR obtain from beneficiary on distribution?
Confirmation of receipt.
Who cannot provide receipt?
Minors, unless specific conditions met.
