Courts admit evidence on the condition that the jury will decide preliminary fact.

A
Rule 403
When certain risks substantially outweigh its probative value.
Ex. Confusion of issues, prejudice, waste time, mislead jury.

A
FRE 401 and 402
Must be relevant to be admissible.
Irrelevant evidence inadmissible.
Relevance = makes the fact in issue more likely than it would be without the evidence.
Evidence is relevant if its material and probative.
