What are the constitutional limitations on the hearsay rule?

Confrontation Clause
- If testimonial, not allowed unless: declarant unavailable and defendant had prior opportunity to cross examine.
If made for ongoing emergency, not testimonial.
Testimonial = primary purpose of ascertaining past criminal conduct.
