Supremacy Clause
- A conflict exists between Federal and State Law
- In a conflict, Federal Law ALWAYS wins
Tenth Amendment
Police Power
- State Law can be MORE RESTRICTIVE than Federal Law
- Cant be LESS restrictive (i.e. 400 degrees to cook meat when FDA says 350 degrees)
- States have POLICE power: can pass laws for health, safety, and welfare
Does Federal have police power?
NO! Federal cannot pass laws for general welfare
Commandeering Rule
- Federal Government cannot pass a law requiring a state to do anything
- “command, require, obligates”
Dormant Commerce Clause
*State is passing a law regulating business interest
*State Law regulating business CANNOT discriminate against out-of-state business. Unconstitutional!
Congress: Commerce Clause. Do whatever you want
State: Dormant Commerce Clause. Cannot do sth that will discriminate!
But they can sometimes leave out the word “Dormant”

Market Participant Exception
- Market Participant = State itself runs that industry/business
- State may discriminate
Full Faith & Credit
judgment in one state must be given full faith and credit in another state
Immunity
- Immunity
- State Immunity
Federal Immunity
- States cannot sue Federal Government
- States cannot tax Federal Government
- State can tax INDIVIDUALS who work for the Federal Government
- Individuals cannot sue Government, unless consent (statute)
State Immunity
- Federal Government & State can sue a State
- Federal Government MAY NOT tax if it is about government activity or function
- Federal Government MAY tax if it’s a proprietary business that happens to be in state property (i.e. gift shop in a courthouse)
