Q

Is there a criminal law restricting taking photos in a public place?

A

No

College of Policing guidelines state it is not an offence

Specifically they state:

  • Police should not prevent filming/photography in a public place
  • It’s good practice for police to give media a better vantage point to take pictures from
  • Once an image has been recorded the police have no power to seize a journalist’s camera
  • Only exception is if the police believe that person is a terrorist
