Wages & Determination of Wages

A

As a general rule, wages due to the workers shall be paid in Iraqi currency, unless otherwise specified in the employment contract.

The employer pays wages directly to the worker and may be transferred to the account of the worker with the bank.

In case of enterprise bankruptcy or liquidation, the workers shall be considered preferential creditors.

The individual employment contract shall determine the wage. The wage must NOT fall below the minimum wage.
As of today, IQD 380,000 is the minimum wage in Kurdistan.

Working Hours

A

The term “Working hours” means the time the worker must work for the employer excluding the rest and meal periods.

The daily working hours shall not exceed (8) eight hours per day or forty- eight hours (48) per week.

Payment of Overtime

A

The Labour Law defines ‘overtime work’ as any work performed:
A. During daily or weekly rest periods;

B. On feast days and public holidays; and

C. In excess of the daily working hours.

1)In case of an accident or imminent accident, urgent repair of devices or machines.
2)If the work circumstances require performing extra working hours.
The total amount of overtime cannot exceed 40 hours over a 90-day period or 120 hours over a 12-month period.
