What are legislative/substantive rules?
Rules that implement a statute. They have the force and affective law. Meaning they’re legally binding on an agency, the public and the courts.
What are non legislative rules?
Referred to as Guidance documents and they include interpretive rules and policy statements
What is management and procedural rules? And what are the two types?
The DOT defines two types of these kinds of rules
1) management, or personnel
2) organization, procedure or practice
What are management or personnel rules?
The running or supervising of the FAA‘s business, and they don’t affect the public.
What are organization procedure or practice rules?
These rules describe the FAA structure and functions, as well as the way the FAA makes determinations.
What is informal rulemaking?
Also known as notice-and-comment rulemaking
(5 USC 553)
Establishes procedures and broadly applicable federal requirements for informal making
(Required NPRM, after comments)
