Guidance to journalists for photography 1 and 2
- there is no criminal law restricting the taking of photographs, filming, videoing or recording in public places, e.g. in the streets
- journalists who experience any attempts by police, PCSOs or other officials to prevent such activity should point to ACPO guidelines
Guidance to journalists for photography 3 and 4
- ACPO says police should not prevent filming etc in public places and it is ‘good practice’ for police to give the media a good vantage place if an area is cordoned off
- ACPO guidelines say police can only seize film or a camera at the scene on the strictly limited grounds that it is suspected to contain evidence of a crime

- once a photographer has left the scene police can only seize images if empowered to do so by a court order
- Police have no power to insist that images be deleted
What are the restrictions for taking photos in court?
Makes it illegal to take any photograph, or make any sketch of “any person in any court, its building or its precincts”
or of “any person while they are entering or leaving a court building or its precincts
Can you take a photo of a defendant outside of court?
Yes if it is on a public street
Can you use an audio recorder in court?
makes it illegal to use any audio recorder in court unless court gives permission
