What are the terms of PD 2/2007?

UCPR 261A - The court can make a ‘search order’ for the purposes of securing or preserving evidence which is relevant to the proceeding. This can include the respondent being required to permit a ‘search party’ to enter a premises for this purpose.

PD 2/2007 outlines what is to be included in the supporting affidavit for a search order, the search party requirements ( independent solicitor to supervise, limit number of persons), return date considerations.

What are the terms of PD 11/2012?

A

PD 11/2012 - Supervised case list

Where a party estimates the length of a trial will exceed 5 days or demand greater resources then normal can request at any time matter to be placed on supervised case list (PD 11/2012).

The purpose of the list is to optimise time allocation to hearing and manage preparation of trial.

PD 11/2012 prescribes what must be considered prior to a trial date being allocated.

Judge may remove a matter from the list.
