Who can issue a PSO?
A constable can issue a PSO but it needs to be authorised by a Sergeant or above.
Who is the bound person?
The person against whom the order is issued
Do Police need the consent of the person at risk to issue a PSO?
No.
This also avoids blame being issued at the person for police action.
Who can not have a PSO issued against them?
A person under 17 years old
What is the duration of a PSO?
Comes into place immediately and can last up to 5 days
When a PSO is issued what must a bound person do?
Surrender weapons and firearms and immediately vacate the land occupied by the person at risk.
What is a PSO?
An order issued by a constable (on a prescribed form) to a bound person to ensure the protection of the person at risk.
What is the purpose or intention of a PSO?
When attending an incident and you are certain family violence has occurred but don’t have sufficient evidence you can issue a PSO to allow a cooling off period and you fear the violence may occur again once you leave.
Who is defined as a person “at risk”?
- any person named in the PSO
- any child residing with that person
Can you arrest for a family harm incident and issue a PSO?
No. PSO can only be issued if no arrest is made for family violence. PSO can be issued in relation to other offences if necessary.

- effect of the order
- duration of the order
- consequence of contravening the order
