What is Note 1?

A

A Police Officer can question anybody however that person does not have to answer.

What is Note 2?

A

Whenever a Police Officer has sufficient evidence to charge a person with an offence or question them whilst in custody the person must be cautioned before being invited to make a statement/answer questions.

A

Suspects must not be cross-examined.

What is Note 4?

A

When a suspect is being questioned about statements made by others the the substance of the allegation must be put to the suspect.

What is Note 5?

A

Any statements made in custody should preferably be recorded by video. If the person doesn’t want to be filmed then an audio recording can be taken. A written recording is the other option. Suspects must be offered a chance to review the recordings.
