Is proximate cause a limitation of liability?
A
Proximate cause is a limitation of liability. It deals with liability or nonliability for unforeseeable or unusual consequences of one’s acts. In addition to being a cause in fact, the defendant’s conduct MUST ALSO BE the proximate cause of the injury for the defendant to be liable. If his conduct is not the proximate cause, he is not liable.
