What are the definitions of intellectual and industrial property?
Intellectual property (IP), the intangible asset that comprises or results from creativity, innovation, invention, know-how, and reputation
Industrial property – patents, trademarks, industrial design and
geographic origin.
What are the definitions of Utility and Petty Patents, Licensing, and their duration?
Utility Patent– protect utilitarian, functional items and relationships,
physical embodiments of innovative ideas, and discoveries (20 years).
Petty Patent – protect utilitarian/functional items and relationships that are worthy of an incentive but don’t quite meet the threshold standard requirements for a utility patent (10 years).
Licensing - Agreement between two parties, with one being owner of a certain information, process or technology under protection by patent, trademark or copyright.
What are the definitions of Trademark, Copyrights and Industrial design rights?
Trademark is the differentiation sign that identifies certain goods or services as the ones produced or provided by a certain company. It is used to identify the source or origin of a product or service, distinguishes goods or services of one company from another.
* It can be word, symbol, design or combination thereof, along with
slogan, or even specific sound, which identifies property over
certain product or service.
* Provides the owner with the exclusive right to use for identification of goods or services, allowing someone else to use it for a fee.
Copyright - literary pieces, films, musical pieces, artwork, architectural design.
Industrial design
* Protect non-utilitarian/ nonfunctional appearance and designs.
* Decorative or aesthetic appearance of an item. In order to be protected, it needs to be new, or original and non-functional.
* May consist of three-dimensional properties – form of surface of an
item or two-dimensional property – prints, lines or colour.
* Owner, a person or a company that registered design, secured exclusive right against unauthorized copying or imitation of design by third party
