Define robbery
s8 - A person will be found guilty of robbery if they use or seek to use force immediatley before or at the time of a theft.
Theft
There must be a completed thef otherwise there can be no robbery (Robinson)
Use or threat of use of force
(B and R v DPP), it is up to the jury to decide whether the act amounts to force using normal definition of the word
When can force be used?
Immediatley before or at the time of theft, however the court will allow robbery for force used to escape (R v Lockley)
Force must explicitly be used to steal
If one committs battery and later decides to steal, there will be not robbery (Robbery)
Mens rea is the same as theft, plus……
