What is the definition of robbery?
Taking property from someone unlawfully by force or by threat of force.
What is the authority that sets out the definition of robbery?
S8 of the Theft Act
What is the AR of robbery?
- theft (appropriation, property, belonging to another)
- Force or putting or seeking to put any person in fear of force.
What is the MR of robbery?
- MR of theft ( dishonesty, intention to permenantly deprive)
- intended to use force to steal.
Explain force/threat of force (AR)
The jury will decide if the defendants actions will amount to use of force, they must use force or intend to cause the victim to fear the use of force.
