A
The promise in a writing (e.g. the deed) that satisfies the statute of frauds. The promise restricting the use of the vacant land touched and concerned the land, placing a burden on the vacant tract and giving a benefit to the improved tract. A writing showing an intent that the promise would be binding on the grantee’s heirs and assigns. The deed recorded.
