Supplemental Jurisdiction

The federal statute that confers supplemental jurisdiction, 28 U.S.C. § 1367, has two requirements. First, the federal court must have original jurisdiction over one or more of the plaintiff’s claims. If it does, the court may exercise supplemental jurisdiction over any other claim(s) in the action that “form part of the same case or controversy under Article III.” The Supreme Court has interpreted that language to implement the “common nucleus of operative facts” test.
